Purpose of Personal Data Processing Personal data is used for managing customer orders and delivering goods. Purchase history data (purchase date, goods, quantity, customer data) is used for compiling an overview of purchased goods and services and analysing customer preferences. Bank account number is used for processing refunds to the customer. Personal data such as e-mail, phone number, and customer name are processed in order to resolve issues related to the provision of goods and services (customer support). The IP address of the online store user or other network identifiers are processed for the provision of the online store as an information society service and for compiling web usage statistics.
Legal Basis Personal data processing is carried out for the purpose of fulfilling a contract concluded with the customer. Personal data processing is carried out to fulfil a legal obligation (e.g. accounting and resolution of consumer disputes).
Recipients to Whom Information is Forwarded Personal data is forwarded to the online store customer support for managing purchases and purchase history and resolving customer issues. Name, phone number and e-mail address are forwarded to the transport service provider chosen by the customer. If the goods are delivered by courier, the customer's address is forwarded in addition to the contact details. Personal data is forwarded to the accountant providing services to the service provider. Personal data may be forwarded to information technology service providers if necessary to ensure the functionality or data hosting of the online store.
Security and Data Access Personal data is stored on zone.ee servers located in the territory of a European Union member state or a state that has joined the European Economic Area. Data may be forwarded to countries whose level of data protection has been assessed as adequate by the European Commission and to US companies that have joined the Privacy Shield framework. Access to personal data is granted to online store employees who can access personal data in order to resolve technical issues related to the use of the online store and to provide customer support services. The online store implements appropriate physical, organisational and information security measures to protect personal data against accidental or unlawful destruction, loss, alteration or unauthorised access and disclosure. The transfer of personal data to the online store's authorised processors (e.g. transport service provider and data hosting) is carried out on the basis of contracts concluded with the online store and authorised processors. Authorised processors are obliged to ensure appropriate protective measures when processing personal data.
Accessing and Correcting Personal Data Personal data can be accessed and corrections made in the online store user profile. If a purchase has been made without a user account, personal data can be accessed through customer support.
Withdrawal of Consent If personal data processing is based on the customer's consent, the customer has the right to withdraw consent by notifying customer support by e-mail: info@hingamiskeskus.ee
Terms of Sale
Hingamiskeskus online store (hereinafter the Online Store) is owned by Hingamises OÜ (registration code 16856275) located at Sõle 14, Tallinn, Harjumaa 10611.
Validity of Sales Agreement, Product and Price Information The terms of sale apply to the purchase of goods from the Online Store.
The prices of products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. The delivery fee depends on the buyer's location and the method of delivery. The delivery fee is displayed to the buyer when placing the order.
Information about the goods is presented in the Online Store directly next to the goods.
Placing an Order To order goods, add the desired products to the shopping cart. To complete the order, fill in the required fields and choose a suitable delivery method. The amount to be paid will then be displayed on the screen, which can be paid by invoice in euros.
The contract enters into force upon receipt of the payable amount to the Online Store's bank account – Hingamises OÜ EE147700771009732310 LHV. If it is not possible to deliver the ordered goods due to the goods being out of stock or for any other reason, the buyer will be notified as soon as possible and the paid money (including delivery costs) will be refunded immediately, but no later than 14 days from sending the notification.
Delivery Goods are shipped within Estonia to Itella, Omniva and DPD parcel machines. Shipping costs are borne by the buyer and the relevant price information is displayed next to the shipping method.
Domestic shipments generally reach the buyer's specified destination within 3-7 working days from the entry into force of the sales contract. In exceptional cases, the right is reserved to deliver the goods within up to 45 calendar days.
Right of Withdrawal After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days. The right of withdrawal does not apply in the cases listed in §53(4) of the Law of Obligations Act, for example in the case of goods that deteriorate or expire quickly, that are not suitable for return for health protection or hygiene reasons and have been opened after delivery. The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing goods in a physical store. If the goods have been used for purposes other than what is necessary to verify their nature, properties and functioning, or show signs of use or wear, the Online Store has the right to reduce the refund in accordance with the decrease in the value of the goods.
To return goods, a withdrawal notice must be submitted and sent to info@hingamiskeskus.ee no later than 14 days from receiving the goods. The cost of returning the goods is borne by the buyer, unless the reason for return is that the item to be returned does not match what was ordered (e.g. wrong or defective item). The buyer must return the goods within 14 days following the submission of the notice or provide evidence that the goods have been handed over to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Online Store will refund all fees received from the buyer under the contract immediately, but no later than 14 days from receiving the withdrawal notice. The Online Store may refuse to make refunds until it has received the contractual item back or until the buyer has provided evidence of having returned the item, whichever occurs first. If the buyer has explicitly chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the cost exceeding that of the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the online store has been marked significantly below the market price due to an error.
Right to File a Complaint The Online Store is responsible for non-conformity or defects in goods sold to the buyer that existed at the time of delivery and that become apparent within two years from the delivery of the goods to the buyer. During the first six months from delivery, it is presumed that the defect existed at the time of delivery. It is the Online Store's obligation to rebut this presumption.
The buyer has the right to contact the online store within two months of discovering a defect by sending an email to info@hingamiskeskus.ee. The Online Store is not responsible for defects that arose after the goods were delivered to the buyer. If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer. The Online Store will respond to a complaint submitted by the consumer in writing or in a format that can be reproduced in writing within 15 days.
Personal Data Processing The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, bank details) to process orders and send goods to the buyer. The Online Store forwards personal data to companies providing transport services in order to deliver the goods.
Hingamises OÜ may send clients information about its services, products, newsletters and offers by email or phone if the client has provided their contact details and consent, but only until the client has requested the cessation of such activities or has left the newsletter recipient group by notifying the Online Store by email at info@hingamiskeskus.ee or by following the instructions provided in the offer.

Dispute Resolution If the buyer has complaints regarding the Online Store, these should be sent to info@hingamiskeskus.ee. If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer may turn to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority. The Consumer Disputes Committee has jurisdiction to resolve disputes arising from contracts concluded between the buyer and the Online Store. The review of the buyer's complaint by the committee is free of charge. The buyer may turn to the European Union's online dispute resolution platform for cross-border disputes.
